Verdicts and Settlements

SETTLEMENT - DEFENSE OF PREMISES LIABILITY

Plaintiff, Tierney Darden, 20 year-old student, was with her mother and sister at O’Hare Airport on August 2, 2015 when a sudden rain storm arose with winds sufficient to topple a 750 pound fiberglass bus shelter onto the three of them while they were sheltering behind it. As a result, Tierney suffered an injury to her spinal cord that severed the spinal cord at T11-12. Plaintiff alleged deficiencies in the maintenance of the supports to the shelter. The City admitted liability at trial.

SETTLEMENT - CIVIL RIGHTS/UNLAWFUL DETENTION

Case against airport security officer Plaintiff, a cabbie, servicing Midway Airport, parked in an unauthorized section waiting for his fare to come out of the Arrivals hall. Defendant, a City of Chicago police officer assigned to Midway Airport, asked the Plaintiff to move along. After a couple of requests, Plaintiff moved a short distance ahead and stopped again, also in an unauthorized location.

SETTLEMENT - DEFENSE OF AIRPORT

Plaintiff, a United Airlines employee, slipped and fell on water on the floor in the tunnel connecting B and C Concourses at Terminal 1. Plaintiff sustained a displaced patella fracture. She had $8,000.00 in medical bills and $6,000.00 in lost wages. There was a workers’ compensation lien of $42,479.61.

SETTLEMENT - DEFENSE OF PREMISES LIABILITY

Plaintiff, a 48 year-old woman was exiting the mall with her husband returning to their car at night on Christmas Eve when she stepped in a pothole causing her to fall and sustain injury primarily to her chin and lower face.

VERDICT - PREMISES LIABILITY

Plaintiff, Nancy Mills, sued Simon Property Group for negligence alleging that a planter portion of a fountain in the center court of the River Oaks Mall in Calumet City Illinois was a trip hazard. The planter was raised six inches off the floor, and extended three feet out from the two and a half foot high raised fountain wall. The planter was made of the same colored granite tile as the surrounding floor tile. Plaintiff tripped over the edge of the planter and fell into the two and a half foot high wall causing a three part fracture to the proximal humerus of her right/dominant shoulder.

SETTLEMENT - CONSTRUCTION

Plaintiff, a 42 year old male apprentice roofer falls off allegedly improperly secured ladder injuring knee and shoulder. Plaintiff claimed the ladder, which was secured by a bungee cord around the ladder hooked to the coping of the roof, should have been positively affixed. Defendant alleged that Plaintiff’s fall was caused by his own misuse of the ladder when he unbalanced the ladder, it slid sideways, and Plaintiff panicked, causing the ladder to fall to the side. Plaintiff sustained shoulder injury involving a labral tear that required surgery.

SUMMARY JUDGEMENT - BATTERY

Plaintiff, male, 38 years old, came to insured’s restaurant/bar with wife’s work group to karaoke. Plaintiff went outside to smoke a cigarette and got involved in a fight between two unknown men. Plaintiff was hit in the head with a bottle by one of the men. Plaintiff then went back into the establishment for assistance in calling 911. Plaintiff claimed assistance was refused, so Plaintiff went back outside where he was involved in a second altercation with additional unknown individuals and again hit in the head with a bottle.

SETTLEMENT - CONSTRUCTION/PD SUBRO

A 34 story new construction condominium building with construction almost complete sustained extensive water damage due to a broken five inch water pipe in a 31st floor utility room late at night. The damage extended from the 31st floor down to the 5th floor and was discovered the next morning. Plaintiff/owner incurred damages of approximately $20,000,000.00. Due to prior litigation and various forms of waivers, the building owner was precluded from suing the plumber and the general contractor.
